I lost 6,000.00 to this 21st Century legal service scam and almost lost my house. Help me get back some or all of my money
We became aware of this company in August of 2008, my wife was listening to KJLH radio, the Kevin Nash show, when he introduced Nate McCall a representative of Saving the American Dream, they were overjoyed that here was a company that had what it took to assist those who had been victim of predatory lending, those who found themselves in an upside loan and even those who were at the door of foreclosure. There was to be a “you must be there” meeting the coming Saturday. I of course told my husband we should at least go and listen. “BOY I WISHED I’D CHECK S.T.A.D. OUT FIRST”, the first meeting there was a lot of skepticism, so we attended another meeting, this one we actually sat down with Mr. McCall and yet still a bit reluctant, and needing the help, we presented S.T.A.D. the monies needed to start working for us, which I’ll add went from $1250 to $2450, all of this with the promise of a resolution not longer the 120 days with payments only being up to at maximum 90 days, also we were promised someone in the legal department would be calling us in 14 days once that department got all our paperwork had been gathered for the initial start of the process. August 2006 passed we were now in September, on the 26th I called STAD and was told they lost my paper work in the process of moving, but it was in the computer being corrected as of September 15, 2008, In October ‘08, I was reassured that everything would be finished by November 2008.
In October 2008 and after several calls to the company we took time to travel to Orange County to meet with David Bennett the C.O.O, after 3 1/2 hours of going over the file we brought down, since for some reason S.T.A.D. lost the first some months prior, Mr. Bennett expressed to us that we indeed had been victimized and S.T.A.D. indeed could help us, and that everything would be ok from that point on. His word I tend to really count. Meanwhile the mortgage company provided us with their numbers and names to modify my loan, STAD took this information, but never called once just taking our monies and doing/having done anything. I understand the lender like to have paperwork updated by asking for new paper every 60-90 days, this clearly says we’re not doing our job in a timely manner, also to add salt to injury STAD asked for a new retainer 5x’s, why there is no reason except they were not keeping track of the agreement. I’ve been humiliated by Mr. Bennett’s secretary many times as well as by Jessica Zimmerman, Mr. Mendoza and Ms. Amber was not as bad as the rest. Ms. Zimmerman should be a prison guard because, the attitude she expressed to me was poor trash, you don’t understand that the USA, the whole country is and has been in a disaster financial state and you dare say to a client you don’t care about what troubling them concerning their home (never listening to my complaint) you need no job in this business. People need help not broken down or torn into tiny little parts to be blow away by any one of you all especially Ms. Zimmerman. How disappointing. I’ve asked for 2-2 ½ months at a time to speak with Mr. Bennett, who never really returned my calls, and if and when he does, he’s talking 100 mph in a manner of speaking, in other words you are being rushed through the conversation, so not much is resolved. In our meeting Mr. Bennett went further to say that we would be speaking with the company’s attorneys within 14 days, that he personally would facilitate our case that he and his assistants Mr. Vargas and Tammy would indeed stay on top of everything and keep us informed. We find out that the first steps by S.T.A.D. did not take place until December 2008; this is 5 months after we’ve given them $5000 and later found it didn’t happen then.
In February 2009, after having been asked on more than 4 occasions by S.T.A.D. to provide more financial records, tax returns, doctors letters, attorney releases and heart ship letters we began with more vigor to insist on what exactly was going on. Sadly at this point we are still not sure, we believe we have spoken to almost everyone in this company, with no results. In March of 2009 having spoken to Mr. Mendoza who said to me, “a person thinking STDA had finally finished my loan instead I was told “If I were you, I’d line up all my things and weight what was more feasible maybe just walk away from my home”. I was shocked; I really never ever expected to hear those words. I was crushed, I reported this to STAD, but it was handled very nonchalant, sadden but pressing on, I spoke again to Mr. Bennett’s secretary as many times before not to be able to talk to Mr. Bennett.
In March of 2009, I was happy to receive a call from Mr. Bennett, here was my chance to let him know that after all of his promises, nothing had been done, I wanted to let him know that even my mortgage company was in agreement to modify my loan from May 2007-December 31, 2007 on one of my loans, STAD laziness and poor performance allowed after sic months for my loan to be sold. My mortgage company even sent to STAD their contacts and phone numbers to expedite the procedure in October 2008 via myself, STAD made no contacts with my mortgage company from August 2008- May 2009. Being asked for more documents and signing a retainer for the fourth or fifth time, that’s a bit strange, see one retainer should be enough, I’ve provided everything STAD requested, I have no reason not to, I really thought when I was introduced to STAD it would all be over, getting misled, overcharged and just plain charged when noting had been done. I’d advised STAD of having developed serious health problems, in the last 2 years I’ve had to go to the doctor every week I am also seeing a physiologist, it’s not fun. I have had a problem with my speaking motors, but I do have someone with me every day in case I get upset. My hands are raw and they really hurt, they bleed from my excessive scratching, which has developed due to my nerves. I haven’t slept in so long, a good nights rest would be a treat, I’m on so much medication which STAD is aware of, so why they have elected to treat me like crap I really don’t understand.
My desire for assistance from STAD never changed, I was told STDA would first view my files, get the complete paperwork on my loan fro the mortgage company, check also for any violation in order with the loan and ad is set up entirely, also if found out that the mortgage company owed me more they would most likely give me my home for free rather than to pay the borrower, “they will give you your home”. Now if anyone mortgage goes up 2 times plus ½ higher within 1 ½ weeks and interest only with a negative am, you’d be looking, investigating any and everyone who could clean up all the problems you have. For some reason STAD doesn’t really take peoples livelihood serious at all, instead they rip them off, lie to them, waste all their precious time to fix the problem and you’re left with no home or life, maybe the relationship with your mate due to all the pressure you’ve been under dealing with STAD.I don’t have words for my disappointment in this company, the let downs for all the trust I put in STAD, they talk a good rap, but they don’t do anything, and as time goes by you’ll notice that the black/white thing come out oh yeah! “we’ve got blacks working here”, well I feel very deep for them, you see as humans, hatred is taught and learned, I’m sorry I had to be victimized in California by STAD and it’s disgusting company and crew, they should all be placed in prison, so that maybe someone take something valuable from them like their freedom, maybe David Bennett, Jessica Zimmerman, Carlos Mendoza and Ms. Amber who seem to think blacks are uneducated, thinking if I talk fast, his brain can’t keep up or I’ll just talk over his voice , never hearing a word he’s saying, the above mentioned share this trait
In April 2009 having David Bennett to finally return a call, he advised that S.T.A.D. could not assist us further, and would be remitting our monies according to the terms of the agreement. May of 2009 we were hearing from S.T.A.D that we should prepare the process to possibly take up to a full year and half. It was June when we, after again several phones calls, now about the refund, that we directed a letter to Mr. Bennett, reminding him of his word to refund our monies. Of course all we’ve gotten has been again phones calls requesting documents to get to the attorneys.
I love the misguiding tactics STAD use to put potential clients into their web, STAD have the duty to perform what they promise or just simply give one’s money back. STAD lied about their length of time in the business, frankly if I’d known the business had only been in existence a couple of months prior to my wife hearing this broadcast, I never would have signed a thing with this company. STAD try to lock people into $100,000.00, first to the attorneys the rest to benefit them, we have found that the only thing STAD can really do is comprise a file for an attorney review, requiring $$$ thousands to do that, who in their right mind would or could pay for this type of practice. If Saving the American Dream were to settle my case for $200,000.00, then the first $100.000.00 would go to the company, so in reality I’ve would have only been helped of $100,000.00 of debt, they are crooks, how is that helping anyone, crooks because they are not doing business on that level or manor “guaranteed winner”, now STAD is quick to say not guarantees, which was not the first sales pitch, I don’t vote that way, meaning give one dime unless you’re convinced me and that’s not easy.
Saving the American Dream informed me and my wife via telephone, that they could not help us, from the attorneys they were told they could do nothing for us after 8 months, I was pissed at David Bennett for he said my refund check was in the mail that was in March of 2009. In April I was told once again that my check was in the mail. I like my home and I do all I can to fix this problem, STAD definitely sat on your @%#@ and did absolutely nothing as I’ve said, they are crooks, and I feel no pain in saying it, STAD left me high and dry I went out on my own, I faxed paperwork 5-28-09 and cleared modification 6-30-09, took $200,000.00 off the principle all to my doing, no halves, plus a lower 2.3% apr for 2 years with a 5% apr for the remainder of the loan including principle and interest. Now tell me how can I do this in 32 days and at the same time STAD is asking for documents again, I’m truly insulted, STAD kicked us to the curb long ago, I didn’t need to provide one more thing, again they were lying trying to get more of my hard earned money. STAD stopped not me!
That loan was finalized in June 32 days later, and it has been 11 months and days and the clowns at STDA have not contacted the mortgage company, since never, according to Ms Zimmerman and Mr. Mendoza stating they both need more documents, and once they were received they would move forward, either STAD does not keep record of the request made for clients documents, and me returning the documents via fax upon request and I don’t hear anything from the company most of the time to say they are in receipt, but I have document delivery confirmation. Mr. David Bennett it is only fair that you refund our monies as promised, to make matters better for us, the lender is looking to lower my loan principle even lower, now while waiting from August 2008 to December 31, 2008, when part of my loan sold to another company awaiting STAD to contact the lender, I mentioned it so many times, I realize it myself, but when the lender reached out and gave me the contacts in their company for STAD use, to have possibly fixed this problem in October 2008, which would have definitely been a timely manner and possibly limit some of the heart ship and constant nightmare I’ve been experiencing.
But I will fix it, I was just misguided by STAD, so if they have not done anything why on God’s green earth would they think they are owed a dime from me, what a fake company that did %#@% and that is real. David Bennett ended the business relationship.
